Yes, you are more than able to write/create your own spells. Modifying spells written by others is also an option. However, I do advise you to stick to your correspondences and research supplies based on what it is you're trying to do. For example, using a herb for sex magic would not be very useful...

Even if your girlfriend isn't able to testify in court, I suggest you ask her to write a letter and have her mother's lawyer give it to the judge. I think the best thing either of you can do is visualize yourselves winning in court. Carrying citrine is also a good idea.
